Former Chief Justice Torkornoo challenges removal from Supreme Court

Former Chief Justice Gertrude Torkornoo has filed a judicial review application at the High Court to challenge her removal as a Justice of the Supreme Court by President John Dramani Mahama.

Justice Torkornoo argues that her removal was unlawful, contending that the recommendation for her dismissal related to her tenure as Chief Justice and not her position as a Justice of the Supreme Court. She maintains that the two roles are subject to distinct constitutional procedures.

In her application, the former Chief Justice is seeking an order of certiorari to quash the presidential warrant of removal issued on 1 September 2025. She insists the action contravened the constitutional provisions governing the removal of justices of the Superior Courts, rendering it “unlawful, null and void.”

Justice Torkornoo is also asking the court to declare that President Mahama lacks the authority to remove a Justice of the Superior Courts except through the processes outlined under Article 146 of the 1992 Constitution.

The case is expected to test the boundaries of presidential powers over judicial officers and could set a new precedent in Ghana’s constitutional law.
